Section 21.11

Indecency with a child involves committing some type of sexual offense against a minor child under the age of 17. Texas Penal Code Section 21.11 states that an individual can be formally charged with indecency with a child if:

  • He or she has committed any sexual offense against a minor that is not their spouse, regardless of whether the child is the same sex or the opposite sex
  • He or she has engaged in sexual contact with a minor, or caused or encouraged the minor in some way to engage in sexual conduct
  • He or she has initiated sexual contact with a minor with the intention of arousing any person
  • He or she has caused a minor to expose their genitals, breasts, anus, or other private area
